By creating an account, accessing, or using Somana (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Service.
The Service is operated by Somana Limited, a private company limited by shares registered in Ireland (company number 817614), with its registered office at Rosemount, Julianstown, Julianstown, Co. Meath, A92 WP70, Ireland.
Your continued use of Somana after any changes to these Terms constitutes acceptance of the updated Terms.
Somana is a wellness application with meditation, mood tracking, journaling, breathing exercises, self-assessment questionnaires, and optional provider-linking features.
Somana is not intended to provide medical advice, diagnosis, or treatment, or to replace professional care. This description is not a legal determination of whether the service is a medical device or clinical decision-support software.
Somana is intended for wellness support and personal mental health management and is not intended for the prevention, diagnosis, monitoring, prediction, prognosis, treatment or alleviation of disease.
You must be at least 16 years of age to create an account and use Somana. Healthcare professional accounts require additional verification, including provision of a valid professional licence number and completion of the verification process.
Standard accounts provide access to personal wellness features including mood tracking, journaling, meditation, breathing exercises, clinical self-assessments, and the ability to link with a healthcare provider.

Somana enables standard users to link their account with a healthcare professional using a unique 16-digit linking code. This linking process is:
Your use of Somana is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
Accepting these Terms establishes your agreement to the service terms. It is not blanket consent to every use of sensitive health data. Where Somana relies on consent to process health information, that consent must be explicit, specific to the stated purposes, recorded and capable of being withdrawn. Meeting the 16+ account-age requirement or acknowledging the Privacy Policy does not replace those requirements.
Journal text and voice recordings are stored on your device, not sent to Somana's servers. Limited journal-related metadata, such as entry date, mood selection or an entry-made flag, may be transmitted. Mood values, assessment responses and scores, activity records, and some information you enter in server-based features are stored on our servers. See the Privacy Policy.
We keep your account identity and contact information while your account is active. Settings provides account deletion and controls for deleting supported categories of data. These controls do not currently erase every copy held on a device, in backups, or by another provider. See the Privacy Policy for the current deletion scope and outstanding arrangements. Any information retained after deletion must have a specific, necessary purpose and an applicable legal basis; a general reference to industry standards is not a retention schedule.
Somana Limited reserves its rights in the Service's original content, features, functionality, design, code, music, audio, and branding. These materials are protected by intellectual property laws. Third-party materials remain subject to their respective owners' rights and licences. You may not copy, modify, distribute, sell, or create derivative works based on Somana Limited's proprietary materials without our prior written consent, except as permitted by law.
You retain ownership of any personal content you create within Somana, including journal entries, voice recordings, and custom content.
By uploading content to Somana, you grant Somana a non-exclusive, royalty-free, worldwide licence to use, store, and display that content solely for the purpose of providing the Service to you. You agree not to upload content that is unlawful, harmful, defamatory, infringes third-party rights, or contains malicious code.
Somana includes PHQ-9, GAD-7, and WHO-5 questionnaires for informational self-monitoring. Their use in Somana does not make the app a diagnostic service.
These assessments are provided for informational and self-monitoring purposes only. They do not constitute a clinical diagnosis, medical advice, or a substitute for professional evaluation.
Somana strives to provide a reliable service but does not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, unplanned technical issues, or factors beyond our reasonable control.
You agree to indemnify, defend, and hold harmless Somana, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use or misuse of the Service or your violation of these Terms.
We may suspend or terminate your account if we reasonably believe you have violated these Terms. You may delete your account through account settings. Account-linked data is removed from the active service through the deletion process, subject to backup retention, legal obligations, and service-provider policies. See the Privacy Policy for details. Journal text and voice recordings stored on your device are not removed by account deletion.
The Service or certain features may be provided in beta or trial form. Beta features are provided "as is" and may contain bugs, errors, or incomplete functionality. Features may change or be removed without notice.
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland. UK residents retain rights under mandatory consumer protection laws.
Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at info@somanaapp.com. Both parties agree to negotiate in good faith for 30 days from the date of the notice.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Somana reserves the right to update or modify these Terms at any time. We will update the "Last updated" date and notify you via the app or by email where practicable. Your continued use of the Service after changes constitutes acceptance.
