1. Acceptance of Terms

By creating an account, accessing, or using Somana (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Service.

Your continued use of Somana after any changes to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

Somana is a wellness and treatment-support application designed to support mental wellness through meditation, mood tracking, journaling, breathing exercises, clinical self-assessments, and optional connection with healthcare professionals.

Somana is not a medical device, not clinical decision-support software, and does not provide medical advice, diagnosis, or treatment. It is designed to complement, not substitute, professional mental healthcare.

Somana is intended for wellness support and personal mental health management and is not intended for the prevention, diagnosis, monitoring, prediction, prognosis, treatment or alleviation of disease.

3. Eligibility

You must be at least 18 years of age to create an account and use Somana. Healthcare professional accounts require additional verification, including provision of a valid professional licence number and completion of the verification process.

4. Account Types

Standard User Accounts

Standard accounts provide access to personal wellness features including mood tracking, journaling, meditation, breathing exercises, clinical self-assessments, and the ability to link with a healthcare provider.

Healthcare Professional Accounts

Healthcare professional accounts provide access to the provider dashboard, enabling viewing of linked patient wellness data. Healthcare accounts require:

  • A valid professional licence number
  • Successful completion of the verification process
  • Mandatory two-factor authentication (MFA)
  • Compliance with the healthcare professional obligations set out in Section 6

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Choose a strong, unique password for your Somana account
  • Not share your account credentials with any third party
  • Notify us immediately if you become aware of any unauthorised use of your account
  • Enable and maintain two-factor authentication if you hold a healthcare professional account (this is mandatory)

6. Healthcare Professional Obligations

If you hold a healthcare professional account, you acknowledge and agree that:

  • You must hold and maintain a valid professional licence throughout your use of the Service
  • You must exercise independent clinical judgment when reviewing patient wellness data through Somana
  • You are responsible for complying with your own regulatory and professional obligations, including medical confidentiality duties and data protection obligations
  • When you access patient wellness data through the provider dashboard, you become an independent data controller of that data
  • You must not rely solely on Somana data for clinical decisions - Somana is a supplementary wellness tool, not a diagnostic or clinical decision-support system
  • You must promptly notify Somana if your professional licence is suspended, revoked, or otherwise becomes invalid

7. Patient-Provider Linking

Somana enables standard users to link their account with a healthcare professional using a unique 16-digit linking code. This linking process is:

  • User-initiated - only the patient can initiate a link by entering the provider's linking code
  • Revocable - the patient can remove the provider link at any time in Settings, immediately stopping all data sharing
  • Limited in scope - providers can view wellness metadata (mood trends, meditation statistics, assessment scores, wellness alerts) but never journal content or voice recordings

8. Privacy and Data

Your use of Somana is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

Journal content and voice recordings are stored exclusively on your device. They are never transmitted to our servers or stored in any database. This is an architectural design decision - no server-side storage exists for this content.

9. Subscriptions and Payments

  • All payments are processed securely through Stripe - Somana does not store your payment card details
  • Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refund requests may be considered in accordance with applicable consumer protection laws and App Store refund policies
  • Somana reserves the right to change subscription pricing with reasonable notice to existing subscribers

10. Intellectual Property

All content, features, functionality, design, code, trademarks, and branding associated with Somana are owned by Somana and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.

You retain ownership of any personal content you create within Somana, including journal entries, voice recordings, and custom content.

11. User Content

By uploading content to Somana, you grant Somana a non-exclusive, royalty-free, worldwide licence to use, store, and display that content solely for the purpose of providing the Service to you. You agree not to upload content that is unlawful, harmful, defamatory, infringes third-party rights, or contains malicious code.

12. Clinical Assessments

Somana includes validated clinical instruments - PHQ-9 (depression), GAD-7 (anxiety), and WHO-5 (wellbeing) - to help you track your mental wellness over time.

These assessments are provided for informational and self-monitoring purposes only. They do not constitute a clinical diagnosis, medical advice, or a substitute for professional evaluation.

13. Health and Safety Disclaimers

  • Somana is not a medical device within the meaning of the EU Medical Devices Regulation (MDR 2017/745). It has not been evaluated, cleared, or approved by any regulatory authority for medical use.
  • The Service does not provide medical advice, diagnosis, or treatment.
  • Somana is not an emergency or crisis intervention service. The Service does not monitor users in real time, and wellness alerts are not guaranteed to be delivered.
  • If you are in crisis or immediate danger, contact emergency services (112/999/911) or a crisis helpline in your area immediately.
  • Somana does not guarantee any particular health outcome.
  • Healthcare professionals using Somana must exercise independent clinical judgment and must not rely solely on Somana data for clinical decisions.

14. Service Availability

Somana strives to provide a reliable service but does not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, unplanned technical issues, or factors beyond our reasonable control.

15. Limitation of Liability

  • Somana's total aggregate liability shall not exceed the amount you have paid to Somana in the 12 months preceding the claim, or €100, whichever is greater.
  • Somana shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Somana specifically disclaims liability for any clinical outcomes, treatment decisions, or health consequences arising from the use of the Service.

16. Indemnification

You agree to indemnify, defend, and hold harmless Somana, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use or misuse of the Service or your violation of these Terms.

17. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may delete your account at any time through your account settings. Upon deletion, your personal data and wellness metadata are permanently deleted from our servers.

18. Beta / Trial Use

The Service or certain features may be provided in beta or trial form. Beta features are provided "as is" and may contain bugs, errors, or incomplete functionality. Features may change or be removed without notice.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland. UK residents retain rights under mandatory consumer protection laws.

20. Dispute Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at info@somanaapp.com. Both parties agree to negotiate in good faith for 30 days from the date of the notice.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22. Changes to Terms

Somana reserves the right to update or modify these Terms at any time. We will update the "Last updated" date and notify you via the app or by email where practicable. Your continued use of the Service after changes constitutes acceptance.
